1. Introduction and Scope
Welcome to the website of Welding Pipe Industry s. r. o. (hereinafter referred to as „the Agency,“ „we,“ „us,“ or „our“). These Terms of Service govern your use of our website and the services we provide as a personnel agency specializing in the placement of qualified professionals including welders, pipefitters, and mechanics.
By accessing our website, submitting an application, or entering into a placement agreement with us, you agree to be bound by these Terms.
2. Definitions
- „Candidate“ : A welder, pipefitter, mechanic, or other tradesperson seeking employment or assignment through the Agency.
- „Client“ : A third-party company (industrial site, construction firm, etc.) requesting personnel services from the Agency.
- „Assignment“ : A specific work placement arranged by the Agency for a Candidate at a Client’s site.
3. Role of the Agency
The Agency acts as an intermediary and, where applicable, as the legal employer in temporary assignments. We provide personnel services under the relevant provisions of Slovak Labour Code (Act No. 311/2001 Coll.) regarding temporary employment agencies.
4. For Candidates (Workers)
To use our placement services, you agree to the following:
- Accuracy of Information: You warrant that all information provided in your CV, certifications (e.g., welding certificates, pipefitting licenses), and trade tests is true, current, and complete. Submitting fraudulent documents is grounds for immediate termination.
- Work Eligibility: You are responsible for possessing the valid legal right to work in the country of the assignment (e.g., EU citizenship or valid visa/work permit).
- Health & Safety: You agree to comply with all Health & Safety regulations and site-specific rules of the Client where you are placed.
- Exclusivity (if applicable): Unless otherwise agreed in a specific contract, you may be required to notify us of any direct engagement by a Client introduced to you through the Agency.
5. For Clients (Employers)
If you are a Client seeking to hire personnel through the Agency, the following applies:
- Job Descriptions: You must provide accurate details regarding the role, duration, salary, shift patterns, and specific required certifications (e.g., MIG/MAG, TIG, structural welding).
- Site Safety: You agree to provide a safe working environment and comply with all applicable Slovak and EU safety regulations for the placed workers.
- Fees & Invoicing: Engagement fees, payroll markups, or introduction fees are due as specified in the separate Service Agreement signed between the Client and the Agency. Standard payment terms are [e.g., 14 or 30 days] from the invoice date.
- Direct Engagement („No Poach“): If you directly hire a Candidate introduced by the Agency within [e.g., 6 or 12 months] without paying the Agency’s introduction fee, a penalty of [e.g., €5,000 to €10,000] or a specific percentage of the annual salary shall be due.
6. Intellectual Property
All content on this website (text, logos, graphics, database of candidates where applicable) is the property of Welding Pipe Industry s. r. o. or its licensors. You may not scrape, copy, or redistribute candidate profiles without written permission.
7. Limitation of Liability
- The Agency acts as a facilitator. We do not guarantee that a Candidate will secure an assignment, nor that a Client will retain a Candidate permanently.
- We conduct verification of certifications; however, the Client is responsible for site-specific skills testing (e.g., weld tests) prior to full deployment.
- To the maximum extent permitted by Slovak law, the Agency is not liable for indirect damages (loss of profits, production delays) resulting from the failure of a placed worker to perform duties.
8. Termination
- By Candidate: You may request removal from our database at any time via email.
- By Agency: We reserve the right to refuse service or block access to any user who violates safety protocols, submits fraudulent credentials, or acts in a manner harmful to our Clients.
9. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the Slovak Republic. Any disputes arising out of these Terms or the placement services shall be submitted to the exclusive jurisdiction of the courts of Košice.
